By creating an account, accessing our calculators, or using any of our services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service, including our HIPAA compliance policies.

2. Description of Service

GuideRPH provides pharmacy calculation tools, educational resources, and AI-powered tutoring for healthcare professionals. Our services include:

  • Professional pharmacy calculators (TPN, Vancomycin, CrCl, etc.)
  • Optional calculation saving with personal reference codes (PINs)
  • Educational resources and AI tutoring
  • Community features for registered users

3. Medical Disclaimer

IMPORTANT: GuideRPH is a calculation tool and educational resource ONLY. It is NOT a substitute for professional medical judgment, clinical expertise, or patient-specific assessment.

  • No Medical Advice: Our calculators and content do not constitute medical advice, diagnosis, or treatment recommendations.
  • Professional Responsibility: Healthcare professionals are solely responsible for validating all calculations and clinical decisions.
  • Patient Safety: Always verify calculations independently and consider patient-specific factors before making clinical decisions.
  • No Warranty: GuideRPH provides calculations "as is" without any warranty of accuracy, completeness, or fitness for a particular purpose.

⚠️ HIPAA COMPLIANCE NOTICE

GuideRPH is NOT a HIPAA-covered entity and does NOT collect, store, or transmit Protected Health Information (PHI).

User Responsibility for HIPAA Compliance:

If you choose to use our optional calculation saving feature with personal reference codes (PINs), you acknowledge and agree that:

  • No PHI Storage: GuideRPH does NOT collect or store any patient identifiers (names, MRNs, dates of birth, SSNs, addresses, or any PHI as defined by HIPAA).
  • PIN Reference Only: The 6-digit PIN system is for YOUR personal reference only. It has no meaning to GuideRPH.
  • Your HIPAA Responsibility: YOU are solely responsible for ensuring your use of GuideRPH complies with HIPAA regulations and your institution's privacy policies.
  • De-Identification Required: Do NOT enter patient identifiers or PHI into any GuideRPH fields, including calculator inputs or PIN systems.
  • Institutional Compliance: You must follow your healthcare institution's policies regarding clinical tools, documentation, and patient privacy.

GuideRPH's Limited Role:

GuideRPH only stores:

  • Your account email and username
  • De-identified calculation results (numbers only)
  • Your personal reference codes (PINs) - which have no patient meaning to us

GuideRPH disclaims all liability for your HIPAA compliance. You agree to indemnify GuideRPH against any HIPAA-related claims arising from your use of our services.

5. User Accounts

5.1 Registration

To access certain features, you must create an account with accurate and complete information. You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized access

5.2 Account Types

  • All Users: Free access to all calculators and features

5.3 Email Verification

You must verify your email address to activate your account. We may require re-verification periodically for security purposes.

6. Acceptable Use Policy

You agree NOT to:

  • Use GuideRPH for any unlawful purpose
  • Enter Protected Health Information (PHI) or patient identifiers
  • Share your account credentials with others
  • Attempt to access or modify our systems without authorization
  • Use automated tools (bots, scrapers) without permission
  • Interfere with other users' access to our services
  • Violate any applicable laws or regulations

7. Intellectual Property

All content, calculators, algorithms, designs, and materials on GuideRPH are protected by copyright, trademark, and other intellectual property laws. You may not:

  • Copy, modify, or distribute our calculators or content without permission
  • Reverse engineer our algorithms or systems
  • Use our trademarks or branding without authorization

8. Privacy and Data Collection

Our Privacy Policy (available at https://rgdphd.com/privacy-policy) describes how we collect, use, and protect your information. Key points:

  • We collect minimal personal information (email, username)
  • We do NOT collect or store PHI
  • We use cookies for essential functionality
  • We may use Google AdSense for ad delivery (guest users)

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • GuideRPH is provided "AS IS" without warranties of any kind
  • We are NOT liable for any damages arising from your use of our services
  • We are NOT liable for clinical errors, patient harm, or professional negligence
  • We are NOT liable for HIPAA violations arising from your use of our services
  • Our total liability shall not exceed $100

10. Indemnification

You agree to indemnify, defend, and hold harmless GuideRPH, its owners, employees, and affiliates from any claims, damages, losses, or expenses (including legal fees) arising from:

  • Your use of GuideRPH services
  • Your violation of these Terms
  • Your violation of HIPAA or other privacy laws
  • Clinical errors or patient harm related to your professional practice

11. Termination

We may suspend or terminate your account at any time for:

  • Violation of these Terms
  • Fraudulent or illegal activity
  • Extended inactivity
  • Any reason at our sole discretion

Upon termination, your right to use GuideRPH immediately ceases. Saved calculations may be deleted.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of significant changes via email or website notice. Continued use of GuideRPH after changes constitutes acceptance of the modified Terms.

13. Governing Law
